General Rental Conditions

 

Eligibility and Requirements

Car rental is available to travelers of all nationalities and Cubans living abroad. However, Cuban citizens residing in Cuba are not eligible to rent through our services. Renters must be at least 21 years old and have held a valid driver's license for more than one year.

Non-Grata Status

Customers can find out if they have been declared "non grata" by a Cuban rental agency, as we cannot access this confidential information. If a reservation is rejected due to this status, no refund will be provided.

Rental Process

  • The contract holder and additional drivers must be present when picking up the vehicle.
  • The main driver must be present; otherwise, the rental may be denied.
  • Only one main or additional driver can be reserved at a time.
  • The following documents are required: proof of travel agency or tour operator, original passport, and a valid driver's license. Name changes are not allowed.
  • The customer must pay all outstanding rental charges.
  • The customer agrees to return the vehicle and all accessories in the received condition, on the specified date and time.
  • If accessories or vehicle parts are missing upon return and were not reported missing at pickup, the customer is responsible for these costs.
  • If the vehicle is seized by authorities due to a crime or violation, the customer will not receive a refund and must cover related losses and damages.

Vehicle Inspection and Refund Rights

Customers have the right to inspect the vehicle at the time of delivery. If the vehicle is unsafe or unfit for use:

  • The rental agency or company must be notified immediately.
  • A statement must be signed noting the refusal to use the vehicle due to its condition.
  • The vehicle must not be driven.

In this situation, a full refund is provided. Once the vehicle is used, the customer accepts its condition and forfeits any refund.

Secure Payment

Credit or debit card payments are processed through a secure online link using 3D Secure (3DS) authentication. This system requires an additional verification step, such as a one-time password or biometric confirmation, to ensure that only the authorized cardholder can complete the transaction. Reservations are confirmed only after successful authentication.

Additional Fees and Cancellations

  • Fees may apply for additional drivers, empty returns, or other services according to the rental company's fee list.
  • Once paid, service cancellations are not allowed and no refunds are issued.

Cancellation Penalties

  • Cancellations at least 60 days in advance: 25% penalty.
  • Cancellations at least 30 days in advance: 50% penalty.
  • Cancellations less than 25 days in advance or no-shows: no refund (100% penalty).

Accidents, Theft, and Returns

  • In case of accident or theft, contact the police (106) and report the incident to the agency.
  • Vehicles must be returned at the scheduled time or within two hours; late returns incur penalties.
  • Unnotified late returns result in an extension fee of USD 100.00 per day, plus daily rental charges.
  • A return more than 5 hours and 1 minute late is considered an extra day.
  • If pickup and drop-off locations differ, an additional fee applies at return.

Legal Requirements and Travel Restrictions

All Travel USA operates in accordance with the regulations of the Office of Foreign Assets Control (OFAC). Customers traveling to Cuba or other restricted destinations must follow all applicable laws and provide the required documentation. The agency is not responsible for changes in government policy, denial of entry, or failure to comply with regulations.

Chargeback Policy

By signing the agreement, customers waive the right to initiate chargebacks for payments made to All Travel USA. All payment disputes must be addressed directly with the agency. Violation of this clause may result in legal action and cost recovery.

Insurance and Coverage

Car rental includes full coverage insurance:

  • Collision Damage Waiver (covers bodily damage and vandalism)
  • Third-party damage coverage

Insurance does not cover:

  • Driving under the influence or by unregistered drivers
  • Damage to windows, wheels, or interior

The insurance fee is non-refundable and coverage begins upon vehicle pickup.

Customer Responsibility and Travel Insurance

The travel agency acts only as an intermediary and is not responsible for missed flights, delays, or invalid travel documents. Customers must ensure all documents are valid before departure. Travel insurance covering cancellations, medical emergencies, and lost luggage is strongly recommended.

Flight Delays and Vehicle Hold

In case of flight delay, customers must contact the agency to request vehicle hold for up to 24 hours, subject to availability and rental office approval. Delays do not extend the rental period or entitle customers to refunds for lost time.

Agency Accreditation and Compliance

All Travel USA Corp and its affiliates are fully certified by ARC (Airlines Reporting Corporation) and IATA (International Air Transport Association). These accreditations ensure professionalism, transparency, secure ticket issuance, and compliance with all relevant regulations.

Licensing and Operations

The agency holds all necessary licenses and authorizations for air bookings, hotel reservations, and car rentals, both in Cuba and internationally. All transactions are conducted with transparency and professional integrity.

Compliance with U.S. Travel Regulations (OFAC)

U.S. citizens traveling to Cuba must comply with OFAC regulations, limiting travel to authorized categories (such as family visits, education, or professional activities). Supporting documentation must be retained for at least five years. Direct transactions with entities on the Cuba Restricted List are prohibited. By accepting these terms, travelers affirm compliance with all regulations.
